SECTION 1 - WEBSITE USE & ACCOUNTS

To place an order, you must be at least 18 years old or have the permission of a parent or guardian. Permission to use this website does not override any age restrictions or suitability warnings applicable to our products. You must provide accurate and current account, billing and delivery information. You are responsible for keeping your login details secure and should contact us promptly if you suspect unauthorised access to your account.

You must not use our website for unlawful purposes, impersonate another person, submit fraudulent information, upload malicious software, collect other customers’ personal information without permission, or interfere with the website’s security or operation. We may restrict access or suspend an account where we reasonably believe these Terms have been breached or action is necessary to protect customers, staff or the website. Where practicable, we will explain the reason and provide an opportunity to resolve the issue. This does not remove your rights concerning orders already placed.

SECTION 2 - PRODUCT INFORMATION

We aim to keep product descriptions, ingredients, nutrition information, prices, images and availability accurate and current. Please contact us if you notice an error or need clarification before purchasing. Product colours may appear differently depending on your screen. Packaging and presentation may change over time. Images are illustrative, but products supplied must still match their description and meet applicable consumer guarantees. We may update product information or discontinue products. Material changes affecting an existing order will be communicated to the customer rather than applied without their agreement. Please follow product directions, age restrictions and suitability warnings. Further information about general website content is provided in Section 16.

SECTION 3 - ORDERS, PRICING & PAYMENTS

Placing an order is an offer to purchase the selected products. An automated order acknowledgement confirms receipt of your order and does not necessarily confirm acceptance. We will contact you promptly if we cannot fulfil your order. Unless otherwise displayed, prices are in Australian dollars and include applicable GST. Shipping charges and any other charges we collect will be disclosed before payment. Where another currency is offered, the selected currency will be shown during checkout.

Prices may change for future purchases. We will not increase the agreed price of an existing order without your consent. We may decline or limit orders on reasonable grounds, including suspected fraud, payment failure, stock shortages, genuine pricing errors or purchases inconsistent with clearly stated promotion conditions. If an issue arises after payment, we will explain the issue and offer an appropriate resolution. Amounts paid for items we cancel or cannot supply will be refunded. Payments are processed through third-party payment providers. You must be authorised to use the payment method supplied. If you wish to purchase for commercial resale, please contact us to discuss wholesale arrangements.

SECTION 4 - SUBSCRIPTIONS & RECURRING ORDERS

We offer Subscribe & Save on selected products. By choosing a subscription, you authorise recurring orders and charges to your nominated payment method at the frequency you select. The subscription price, frequency and applicable shipping charges are displayed during the purchase process. There is no minimum subscription period. You can cancel, skip or modify future orders through your account or subscription management link before the next order is processed.

If you need Customer Service to make changes on your behalf, including cancellation, product changes, delivery frequency or delivery details, your request must be received at least three business days before your next scheduled order date. Once an order has entered processing with our third-party fulfilment warehouse, we may be unable to amend or cancel it. Cancelling a subscription stops future recurring orders but does not automatically cancel an order already processed. Your rights under Australian Consumer Law continue to apply. Subscription pricing may change if the regular product price or applicable subscription discount changes. We will notify you before a price change applies to a future recurring charge and provide an opportunity to cancel before that charge. Subscription orders are also subject to our Shipping Policy and Refund Policy.

SECTION 5 - SALES, PROMOTIONS & DISCOUNT CODES

We may offer limited-time sales, discount codes, free gifts, bonus products, loyalty rewards and shipping promotions. Each promotion is subject to its advertised dates, eligibility requirements, exclusions and other stated conditions. If promotion-specific terms differ from these general promotion terms, the promotion-specific terms apply to that offer. Discounts may vary between eligible products. Selected products, flavours, sizes, bundles, subscriptions or other items may be excluded where this is stated for the promotion. Unless expressly stated otherwise, offers cannot be combined with other discount codes, loyalty rewards, affiliate or ambassador offers, wholesale pricing or special pricing. Where a promotion requires a minimum spend, eligibility is calculated after discounts and excludes shipping charges unless the offer states otherwise. Free shipping offers apply only to the delivery locations and services stated in the offer. Free gifts and bonus products are available while promotional stocks last. If a gift becomes unavailable after an eligible order is placed, we will contact the customer to agree on a suitable alternative or other appropriate resolution. We may refuse a promotional benefit where we reasonably identify fraud or deliberate misuse contrary to the advertised conditions. Any changes to an offer will be communicated clearly and will not remove customers’ existing contractual or statutory rights.

SECTION 6 - SHIPPING & DELIVERY

Delivery services, charges and estimated timeframes are set out in our Shipping Policy. Delivery estimates may be affected by public holidays, carrier delays, customs processing and other circumstances. Please provide accurate delivery information and collect parcels within the carrier’s stated collection period. Contact us promptly if your parcel is missing, damaged or significantly delayed so we can investigate and assist.

Using a third-party carrier does not remove our obligations to you under Australian Consumer Law.

SECTION 7 - RETURNED & UNCOLLECTED ORDERS

Customers are responsible for providing accurate delivery details and collecting their parcels within the carrier’s collection timeframe. If an order is returned to us because of an incorrect address supplied by the customer, refusal of delivery or failure to collect the parcel, we can resend the products once they have been received back in saleable condition. The customer must pay an additional postage fee before the order is resent, even if the original order qualified for free shipping. Free shipping thresholds and promotions do not apply to redelivery. We will confirm the postage fee before arranging redelivery.

Alternatively, the customer may choose a store credit for the amount paid for the returned products, excluding the original shipping fee and any reasonable return-to-sender charges incurred. Any deductions will be explained before the credit is issued. These conditions do not apply where the return resulted from our error or where a different remedy is required under Australian Consumer Law.

For international orders, customers should check import requirements before purchasing. Import duties, taxes and customs charges not collected by us may be payable locally. If customs affects an order, please contact us so we can explain the available options. We do not guarantee clearance by overseas authorities. Your rights under applicable law continue to apply.

SECTION 8 - RETURNS & REFUNDS

Our Refund Policy explains our change-of-mind arrangements and how to request assistance with a product. Our products come with consumer guarantees under Australian Consumer Law. Nothing in our policies excludes or restricts rights or remedies that cannot lawfully be excluded or restricted. These rights also apply to products purchased on sale or through a subscription.

SECTION 9 - INTELLECTUAL PROPERTY

All content on this website, including logos, branding, graphics, images, product names, videos, written content, designs, and other materials, are the property of BlackWolf Nutrition and are protected by copyright, trademark, and intellectual property laws. You may access this content for personal use. You must not copy, modify, distribute or commercially use it without the rights holder’s permission, except where permitted by law.

SECTION 10 - REVIEWS & FEEDBACK

Reviews and feedback must reflect your experience and must not be misleading, unlawful, abusive or infringe another person’s rights. Please disclose any incentive received for a review. When you submit a review for publication, you give us permission to display it on our website and use it in relevant marketing, subject to applicable law and our Privacy Policy. We will not materially alter its meaning. Permission to publish a review does not extend to publishing private Customer Service correspondence. We may moderate content that breaches these conditions. Reviews will not be removed solely because they express a negative opinion.

SECTION 11 - AMBASSADORS, AFFILIATES & PERSONAL VIEWS

We may collaborate with ambassadors, athletes, influencers, affiliates and other promotional partners. A promotional relationship does not, by itself, mean that an individual owns our business or is authorised to speak on our behalf on all matters. Personal opinions, statements and conduct outside an individual’s authorised promotional role do not necessarily reflect the views of BlackWolf Nutrition. Our association with an individual does not constitute endorsement of their personal behaviour, opinions or activities. We do not endorse violence, harassment, discrimination or unlawful conduct. We may review, suspend or end promotional relationships in accordance with the applicable agreement where conduct is inconsistent with our standards. Nothing in this section excludes or limits our responsibility for advertising, representations or conduct for which we are legally responsible, or affects rights under Australian Consumer Law.

SECTION 12 - SHOPIFY & THIRD-PARTY SERVICES

Shopify provides the platform that hosts our store. Purchases through this website are made with us, rather than Shopify. Please contact our Customer Service team about orders or products. Our website may include third-party tools or links to external websites. Those providers have their own terms and privacy practices, which you should review before using their services. We do not control independent third-party websites. However, using third-party services to operate our store does not remove our responsibilities to customers under applicable law.

SECTION 13 - PRIVACY

Personal information is handled in accordance with our Privacy Policy, available on this website. Shopify and other service providers may process information to host the store, process payments, manage subscriptions, fulfil orders and provide related services. Our Privacy Policy explains these arrangements, including relevant overseas disclosures.

SECTION 14 - CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our services or legal requirements. Updated Terms will be published on this page with their effective date. Changes will not retrospectively alter orders already placed. Material changes affecting ongoing subscriptions will be communicated before they take effect, with an opportunity to cancel future orders.

SECTION 15 - GOVERNING LAW

These Terms of Service are governed by the laws of New South Wales, Australia. Disputes may be brought before the courts of New South Wales or another court or tribunal with jurisdiction under applicable law.

SECTION 16 - DISCLAIMER OF WARRANTIES

The information presented on or through our website and services is made available for general information purposes. It is not a substitute for professional medical advice, diagnosis or treatment. Please follow product directions and warnings and consult an appropriately qualified healthcare professional where necessary. We take reasonable care to keep information accurate and current, but do not guarantee that all general information will be complete or up to date at all times. This does not limit our obligations concerning product descriptions, representations made to customers or information required by law.

Except as expressly stated by BlackWolf Nutrition and subject to applicable law, website access is provided on an “as is” and “as available” basis. We do not guarantee, represent or warrant that your use of the website will be uninterrupted, timely or error-free. Our products come with consumer guarantees under Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any warranty, condition, guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

SECTION 17 - LIMITATION OF LIABILITY

To the extent permitted by law, BlackWolf Nutrition, our partners, directors, officers, employees, affiliates, agents, contractors, service providers and licensors are not liable for loss or damage arising from website interruptions or technical faults outside our reasonable control, except to the extent caused or contributed to by our negligence, breach of these Terms or failure to meet our legal obligations. Nothing in these Terms excludes, restricts or modifies any liability that cannot lawfully be excluded, restricted or modified, including liability under Australian Consumer Law. Your rights concerning products purchased through our website continue to apply.

SECTION 18 - INDEMNIFICATION

To the extent permitted by law, you agree to indemnify BlackWolf Nutrition and our officers, directors, employees and agents against reasonable losses, liabilities and third-party claims directly caused by your fraudulent or unlawful conduct, infringement of a third party’s rights, or deliberate material breach of these Terms. This indemnity does not apply to the extent a loss or claim is caused or contributed to by our negligence, breach of these Terms or failure to meet our legal obligations. It does not arise merely because you access our website, purchase or use our products, or exercise your legal rights. We will notify you promptly of a claim for which we seek indemnification and take reasonable steps to minimise the loss. We will not agree to a settlement imposing costs or obligations on you without your consent. Any legal costs sought under this clause must be reasonably incurred.

SECTION 19 - SEVERABILITY

If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, the unenforceable portion will be severed to the extent necessary. That determination will not affect the validity and enforceability of the remaining provisions, provided they can operate independently.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms of Service does not constitute a waiver of that right or provision. These Terms of Service, together with the policies incorporated by reference and any specific purchase or promotional conditions disclosed to you, constitute the agreement governing your use of our website and services. Nothing in this section excludes consumer guarantees, overrides representations we are legally required to honour, or removes rights protected by applicable law. Updated versions of these Terms do not retrospectively alter orders already placed.

SECTION 21 - ASSIGNMENT

You may not transfer or assign your contractual rights or obligations under these Terms without our prior written consent, which will not be unreasonably withheld. This does not restrict the exercise of your statutory rights. We may transfer or assign our rights and obligations as part of a business sale or restructure, provided this does not reduce your existing rights or guarantees. We will notify you where the transfer materially affects an existing order or subscription and obtain your consent where required by law.

SECTION 22 - CONTACT INFORMATION
